Terms of Service

These Terms of Service ("Terms") govern your access to and use of The Market Lexicon ("we," "us," or "the platform"), including our market analytics tools, visual strategy builder, backtesting engine, exchange account connections, and related services (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms.

The Service provides market data, charting, and analytics tools, and a visual builder that lets you design, backtest, and optionally deploy automated trading strategies against a connected exchange account. The Service is a software tool. We are not a broker-dealer, investment adviser, or custodian, and nothing in the Service constitutes financial, investment, tax, or legal advice.

You must be at least 18 years old and legally able to enter into a binding contract to use the Service. You are responsible for ensuring your use of the Service, and any exchange you connect to it, complies with the laws applicable to you, including in your jurisdiction of residence.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us promptly if you suspect unauthorized access to your account.

You may connect a WEEX account to the Service, either by authorizing access through WEEX's OAuth flow or by entering an API key, secret, and passphrase you generate yourself. By connecting an exchange account, you authorize the Service to read account and market data and to place orders on your behalf, strictly according to the strategies you configure and deploy. We do not take custody of your funds — your assets remain held by the exchange, subject to the exchange's own terms. You are responsible for the permissions granted to any API key you connect, and for any consequences of granting excessive permissions.

Some strategy nodes send data to third-party AI model providers to generate a score, signal, or classification used within your strategy logic. AI-generated outputs may be inaccurate, inconsistent, or unavailable, and should not be relied upon as the sole basis for a trading decision. You are responsible for evaluating whether AI-assisted logic is appropriate for your strategy.

The Service may allow you to publish a strategy for other users to view or clone. You retain ownership of strategies you create. By publishing a strategy, you grant other users a license to clone and run their own copy of it, and you grant us a license to display it (including any title, description, and backtest results you provide) within the Service. We do not review published strategies for correctness, safety, or profitability, and make no representation about the accuracy of any backtest results a publisher attaches to a release. Cloning or running a strategy published by another user is at your own risk.

Certain features require a paid subscription, billed through Stripe on a recurring basis at the rate presented to you at signup. Subscriptions renew automatically until canceled. You may cancel at any time from your account settings; cancellation takes effect at the end of the current billing period. Fees are non-refundable except where required by law.

You agree not to:

• Use the Service for any unlawful purpose, or in violation of any exchange's terms of service.
• Attempt to gain unauthorized access to the Service, other users' accounts, or our systems.
• Interfere with or disrupt the integrity or performance of the Service.
• Publish strategies containing deliberately misleading backtest results or descriptions.
• Reverse-engineer, scrape, or resell access to the Service without our written permission.

The Service, including its software, design, and content (excluding user-generated strategies and data), is owned by us and protected by intellectual property laws. These Terms do not grant you any right to our trademarks or branding.

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any strategy will be profitable.

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, or trading losses, arising from your use of the Service, including losses resulting from strategies you build, deploy, publish, or clone, or from the actions of any connected exchange.

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

We may suspend or terminate your access to the Service if you violate these Terms. You may stop using the Service and close your account at any time.

We may update these Terms from time to time. We will update the "Last updated" date above when we do, and for material changes we will make reasonable efforts to notify you. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
